Cancel sharjah tenancy contract and sewa


 


To vacant the property in Sharjah the tenant must have to cancel the tenancy contract and sharjah sewa connection which is for utility bills such as water , electricity.

As you submit the deposit in Sharjah SEWA when we get new connections when rent a proprty, this deposit will be back after this smooth cancellation.

here are the steps to cancel the Sharjah tenancy contract 

Get the NOC from Landlord 

Inform your landlord or agent in advance that you are planning to vacant the property. even your contract is finishing or you are leaving middle of the contract.

If you are leaving middle of the contract on urgent basis the landlord may ask 1/2 month rent or some charges depending on landlord or the rent contract you done with them


Now empty the property and get the NOC from landlord or agency. some provide after the notice some ask to vacant the property so they can check all are ok in the room/flat otherwise they might ask to pay for damages if any.

Cancel tenancy contract 

once you get the NOC visit any Tasheel Sharjah office with your attested tenancy contract, the NOC paper , original and copy of your emirates ID and SEWA bill or SEWA account no

pay around 65 aed fee for tenancy contract cancellation and visit Sharjah SEWA branch of your area to cance SEWA connection.

Close SEWA Account 

In SEWA office show the signed and stamped paper you got from Sharjah Tasheel, emirates id copy , SEWA deposit slip.

they will note down your flat details and contact no as well. give the watchman contact for safe side.

later the SEWA guy will visit flat to close the connection and will note down final meter readings.

with in 10/12 days you will get clearance paper on your mail. you have to re visit sharjah sewa office to get back your deposit money after deductions (if any)

Get the Deposit back

if you haven't got the clearance paper you may visit SEWA office again. there is an urgent connection closing process with 100/150 extra charges but due to current COVID-19 situation its not available.

If you missed the deposit slip they may deduct some amount for that it may be 20 aed per 1000 aed deposit.

I have given 40fays notice to landlord as I don't want to renew the contract but he is not giving clearance and asking for 3 months fine...and harrasing us kindly advice what to do

Pawan, during the time of contract, the notice period was not mentioned? If it is 3 months then you need to discuss with land lord. If no time period mentioned and landlord is giving you trouble you may visit the municipality office with your contract and explain your case.

Sunder, usually there is some grace period / time in given by landlord to settle. It could be 10/15 days. There should not be any rent or charges for that unless you already left the house/flat. It is not a big deal for them to give some extra days. but you have to left the house as or before the contract end.
I don't know much about your case, you have direct contract with landlord of via any agency. Still staying in house or already left before the contract. etc!!!
the legal or not legal can be decide by the department if you can visit and explain them

our contract ended on 9th june, we gave in sewa for cancellation on 10th, they said itll take a few days- the real estate company is saying that they will charge rent for the delay from sewa.

If you leave the flat the. o reason for rent. seea team come and take final readings with the help of watch men. ask real estate to show any written that sewa cancellation period will be charged or go to municipality office visit rental dispute

Hi. Just want to ask, is there any problem if we cancel the contract late after contract due date? Coz our contact ends june 30 and the landlord says that he will give the NOC by july 3, will there be a problem?

Hey wil, there is no issue. may be there will be minor late fee when you submit this cancellation papers in sharjah municipality. I am not sure about late fee it may be there or not. apart from that its normal process.

Sharjah municipal rejected my tenancy. The reason is being a bachelor and they rejected my tenancy getting attestation. I have paid my sewa earlier. What I have to do for getting my money in return.

why you need sewa deposit back? its new contract or you're doing attestation of old contract?? municipality r not doing this attestation now.a days. were you not aware that there is separation of areas/flats in sharjah for family and non family tenants.

I have a pending balance in sewa since I moved out last year. In short my Sewa have not yet closed. Only Sewa is pending, my tenancy contract have been cancelled already. Should I pay any amount to the building owner or they can file against me for not closing my account. please assist me.

I moved out of Sharjah on Feb 2020 and very soon pandemic lockdown started, I couldn't make tenancy cancellation and didn't come back to Sharjah till date. Now its one year my tenancy contract is over. If I come back to Sharjah will it make any issue?

The real estate manager is not giving the clearance letter to cancel the tenancy if I will not give 4kaed plus 7 days rent and he also took my passport as he told that it will take me 7 days to do the cancellation and 4k as guarantee that I will cancel. I went to the municipality and made a request for cancellation. Now the manager is threatening me that whatever I do, wherever I go I will still come back to him. What could happen in this case? No one take your passport as per UAE law. 7 days rent ok if u overstay. 4k condition is not clear to me. get clear explanation from him or ask that you will go to police for passport holding issue

The real state still not issued NOC signatory is still out of the country we requested a month before our contract expired in 30 June 2021 and already one and half month since we vacate the flat.. Is there a penalty? SEWA is another issue still not cancel.

usually its take 7/10 days. Once you submit the documents they will give you a tentative date to come back as someone from sewa will come to note the final reading and close the meters connection.

Sir,my contract finished on 20 august and i inform the landlord one month before but now he is refusing to give NOC for sewa disconnection.I offered him to pay two month rent as penalty but he is forcing to renew contract as in contract it is mentioned to give e month notice.I have taken another flat but he is saying i cant vacate the building unless he gives NOC.

Sir, I am vacating the room as my contract is finishing and I am leaving 10 day period only but the building agency asking me for AED 500/- to cancel the contract is it as per SHJ tenancy contract have to pay for the cancel of the contract.

Yes there is a cancellation fee but it is not 500 may be 200 or less.

I had already vacated my apartment on 17th December and my contract has ended on 19th December. Upon visiting the real estate on 19th December for the clearance from landlord, they informed me that SEWA clearance will take around 10 days and I will have to pay the rent till I submit the SEWA Clearance Certificate. Can you please advise me if it is legal for them to charge extra rent even after vacating the apartment before contract end date?

The landlord or agency can do this on special request. Normally both parties required for signing etc. But they might do due to uncertain situation.

Yes the can charge extra as its not written in contract. Usually the agency do that there is no writings on contract about this. In case of direct contract with landlord they ignore for 10/15 days. Ask agency to give you in written then visit the govt office for clarification

If all ur cheque cleared shud not be any issue. Ask ur friend to check the flat is vacant or check with landlord before coming back

Thanks @Shahid for your detailed blog. Could you please help with a situation I'm now into?
My tenancy contract ended on January 31, 2022. I didn't want to renew the contract as my family is moving back to India in May. I discussed this with the real estate agency and they told me I can continue staying in the apartment till my family moves and I just need to pay the rent for the months I'm staying. Yesterday when I visited the office for paying the rent for February, March, April and May, the real estate office staff told me apart from the rent I need to pay an additional charge of 800 AED at the Municipality as tenancy contract charges. On asking whether this would get me a tenancy contract for 4 months, they told me I can get a 6-month tenancy contract if I pay 920 AED. This includes 4 per cent of the annual rent (28000 AED) plus the service charges. Nowhere on the internet, I could find something like a 6-month contract. I doubt the words of real estate office guys. Could you please confirm?

Normally contact is for an year, but in some cases it can be made for short term like 3 months or 6 months (rare case. All stake holder agree including municipalityTC applied as it was there before digitalization).
if short term is still valid then no issue they give u a valid contact. Get mail for this matter from them then sign it.

Hii..Sir, my tenancy contract is going to finish on 28th april 2022 and I was informed the landlord before 3 months. Now I am vacated and did the maintenance works also. But landlord is not agreeing to give the NOC. He said there are more maintenance work to do, but the flat is in the same condition when I am taking before 3 years. But I don't have any old photographs to prove this. I completed my 3 tenancy contract and paid completely. Kindly advice me in this regards.

My tenancy contract was to expire and the building saw sold to new owners and new management came in ti manage the building and they ask all Africas to vacate the building also bachelors….I’m living with my wife and two sons of 2 years and 4 months old and our nanny….when the new management asked us to vacate the apartment after my contract…I accept but I just paid my last cheque and it was for two months…. My contract expired ending of September and before then I have been looking for a new home but it’s difficult for other buildings around to accept Africa families and the ones that accept are higher…now it’s one month and the management called me yesterday to pay for months I will stay before vacating and I told them by the end of this month I will have complete money to get a new place…..but as it’s I wanted to renew my contract but they refused they don’t need Africans in the building….is that my fault? At least they need to give me time to look for a new place…I cannot move with my family to a sharing apartment…I have to get them somewhere comfortable….they management refused not to renew the contract with us and not me…so what to do now? Please advise…thanks

Nowdays legally landlords are charging 30% of the balance rent amount as penalty for premature cancellation of tenancy. They will give NOC then provided your visa is cancelled.in adition they will not return cheques immediately post sewa clerance and you hv to struggle.

I have done my tenancy contract cancelation via tashjeel office on 31 July and got sewa clearance from them as well. I want to disconnect my sewa on 13 August because I will move then. Should I go to sewa now or just 3 days prior to 13 August for cancelation. I am a bit worried that they may cancel earlier because at tashjeel office they did send some request for cancelation to sewa and shared a CRM reference number with me. Or cancelation only happens once I request at sewa office personally?

Hi, I gave 3 months' notice that I will not renew my contract anymore, the landlord told me to come but I could not because I was out of the country, they told me to renew the contract otherwise they will file a case. what case can they file against me, all the rent was paid, I gave 3 months' notice not to renew, and the contract has ended. the only this is somebody still in the flat and did not evacuated yet.
